1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Ezducate.ai ("Company," "we," "us," or "our"), governing your access to and use of the EZStory platform at ezstory.app (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of an organization (such as a school or educational institution), you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

EZStory is an AI-powered platform for creating personalized children's storybooks. The Service includes:

  • AI-generated personalized stories featuring the child as the main character
  • AI-generated illustrations for each story
  • Text-to-speech narration for all stories
  • Reading progress tracking and analytics for parents and teachers
  • Accessibility features including sensory-friendly themes, adjustable text, and simplified layouts
  • Gamification features (achievements, reading streaks, rewards)
  • Classroom management tools for teachers
  • Printable reading certificates

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. We will make commercially reasonable efforts to notify users of material changes.

3. User Accounts and Eligibility

3.1 Age Requirements

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account. The Service is designed for use by adults (parents, guardians, and teachers) who create content for children ages 3-18. Children do not create their own accounts.

3.2 Account Responsibilities

  • You must provide accurate, current, and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access or security breach
  • You may not transfer or share your account with others
  • We may suspend or terminate accounts that violate these Terms

3.3 Account Types

  • Parent Accounts: For parents and guardians creating stories for their children
  • Teacher Accounts: For educators managing classrooms and creating stories for students
  • Admin Accounts: For authorized platform administrators only

4. Parental Responsibility and Consent

As a parent or guardian using EZStory:

  • You represent that you are the parent or legal guardian of any children whose profiles you create on the Service.
  • You consent to the collection and use of your child's information as described in our Privacy Policy.
  • You are responsible for reviewing AI-generated content before sharing it with children.
  • You are responsible for supervising your child's interaction with content created through the Service.
  • You may review, modify, or delete your child's profile and data at any time.
  • You acknowledge that AI-generated content may occasionally require parental review for age-appropriateness.

5. Teacher and Institutional Use

Teachers and educational institutions using EZStory agree to:

  • Obtain appropriate authorization from their institution before creating accounts
  • Ensure compliance with FERPA and other applicable educational privacy laws
  • Access student data only within the scope of their educational role
  • Not share student data with unauthorized third parties
  • Cooperate with parents who wish to review or delete their child's data
  • Notify us promptly if they leave their educational role or institution

6. Payment Terms

6.1 Subscription Plans

Certain features of EZStory require a paid subscription. Subscription details, pricing, and features are displayed at the time of purchase.

6.2 Payment Processing

All payments are processed securely by Stripe. By subscribing, you agree to:

  • Provide accurate and complete billing information
  • Authorize recurring charges for subscription plans
  • Keep your payment information up to date

6.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.

6.4 Refund Policy

  • We offer a 14-day money-back guarantee for new subscriptions.
  • Refund requests must be submitted within 14 days of the initial purchase.
  • Renewal charges are non-refundable unless required by applicable law.

6.5 Price Changes

We may change subscription prices with at least 30 days advance notice. Price changes will take effect at the start of your next billing period after the notice.

7. Intellectual Property and Content Ownership

7.1 Platform Ownership

EZStory, including its technology, software, AI models, templates, design, and all related intellectual property, is owned by Ezducate.ai. Nothing in these Terms grants you any right, title, or interest in the platform beyond the limited license to use the Service.

7.2 User-Generated Content

  • You retain ownership of the input you provide (child names, preferences, story prompts).
  • Stories and illustrations generated by our AI are provided under a personal, non-exclusive, non-transferable license for your private, non-commercial use.
  • You may print, save, and share generated stories with family and within educational settings.
  • You may not sell, commercially distribute, or publicly republish AI-generated content without our written permission.
  • We may use aggregated, de-identified content data to improve our AI models and Service.

7.3 AI-Generated Content Disclaimer

Content generated by AI may not be eligible for copyright protection in all jurisdictions. The legal status of AI-generated content is evolving, and we make no guarantees regarding copyright ownership of generated stories or illustrations.

8. Acceptable Use Policy

When using EZStory, you agree not to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or inappropriate for children
  • Attempt to generate content depicting violence, abuse, or exploitation of children
  • Use the Service to harass, stalk, or harm any individual
  • Attempt to circumvent usage limits, rate limiting, or security measures
  • Use automated bots, scrapers, or other unauthorized means to access the Service
  • Reverse engineer, decompile, or attempt to extract our AI models or proprietary algorithms
  • Impersonate another person or misrepresent your affiliation with any entity
  • Upload malicious code, viruses, or any content designed to disrupt the Service
  • Use the Service for any purpose that violates applicable law
  • Attempt to access other users' accounts or data without authorization

Violation of this policy may result in immediate account suspension or termination.

9. AI-Generated Content Disclaimer

EZStory uses artificial intelligence (Google Gemini) to generate stories and illustrations, and AI services (OpenAI) for text-to-speech narration. By using the Service, you acknowledge:

  • AI-generated content may not always be perfectly accurate, appropriate, or free from errors.
  • We implement content filters and safety measures, but AI may occasionally produce unexpected or unsuitable results.
  • Parents and teachers should review all generated content before sharing it with children.
  • We are not liable for any harm arising from AI-generated content that was not reviewed by a responsible adult.
  • You may report any inappropriate or concerning content to us for review and improvement.
  • AI-generated content should not be relied upon as medical, therapeutic, or educational advice.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy carefully, as it describes how we collect, use, and protect your information and your children's information. Our Privacy Policy details our COPPA compliance practices and how we handle sensitive data including special needs information.

11. Disclaimers and Limitation of Liability

11.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EZDUCATE.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any content generated by the AI systems
  • Unauthorized access to or alteration of your data
  • Any third-party conduct on the Service
  • Any other matter relating to the Service

Our total aggregate liability for all claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars (00), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ezducate.ai and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

  • By You: You may cancel your account at any time through your account settings or by contacting us. Upon cancellation, your subscription will remain active until the end of the current billing period.
  • By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or pose a risk to the safety of our users (including children).
  • Effect of Termination: Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy and data retention schedule.
  • Survival: Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us atlegal@ezducate.ai and attempt to resolve the dispute informally for at least 30 days.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14.3 Jurisdiction

Any disputes arising from these Terms or the Service that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.

15. Changes to Terms

We may modify these Terms at any time. For material changes, we will:

  • Provide at least 30 days advance notice via email or in-app notification
  • Post the updated Terms with a new "Last updated" date
  • Summarize the key changes

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your account.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Ezducate.ai regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
  • Force Majeure: We are not liable for any failure to perform due to circumstances beyond our reasonable control.
